Terms of Use

These terms explain the rules that apply when you visit and use the 3 Worx Solutions corporate website.

01Introduction

These Website Terms of Use (“Terms”) govern your access to and use of the website operated by 3 Worx IT and Media Solutions (Pty) Ltd, trading as 3 Worx Solutions (“3 Worx Solutions”, “we”, “us” or “our”).

Our website includes www.3worxsolutions.com and any related webpages that link to these Terms (“Website”).

By accessing or using the Website, you acknowledge that you have read, understood and agreed to these Terms. If you do not agree, you must discontinue your use of the Website.

If you are under 18 years of age, you may use the Website only with the involvement and consent of a parent or legal guardian.

The Website is the corporate information and service-discovery platform for the 3 Worx Solutions technology ecosystem.

  • our products and SaaS platforms;
  • our industry solutions;
  • projects and case studies;
  • technology partners and suppliers;
  • training and development programmes;
  • news, insights and downloadable resources; and

The Website may direct you to separate platforms, including 3 Worx Intelligence, 3 Worx Business Suite, One Simple Social, DialoHub, 3 Worx Hosting, 3 Worx Academy, 3 Worx Shop and other platforms within or connected to our ecosystem.

05Separate platform and service terms

These Terms govern the corporate Website only.

Products, subscriptions, purchases, hosting services, training programmes, software platforms and client accounts may be governed by additional terms presented on the relevant platform or during registration, quotation, checkout or onboarding.

Where platform-specific terms apply, those terms will govern your use of that platform or service. If there is a conflict, the platform-specific terms will take priority in relation to that particular platform or service.

Access to the Client Portal may also be subject to an existing customer agreement, service agreement, acceptable-use policy or other contractual terms.

06No automatic service agreement

Information displayed on the Website does not automatically constitute:

  • a binding quotation;
  • an offer to provide services;
  • confirmation of product availability;
  • a service-level commitment;
  • a guarantee of project acceptance;
  • professional legal, financial or regulatory advice; or
  • a binding agreement between you and 3 Worx Solutions.

A binding service agreement arises only when the relevant parties accept a written quotation, order, proposal, service agreement, subscription agreement or other authorised contractual document.

07Permitted use

You may use the Website for lawful personal or business purposes, including:

  • learning about 3 Worx Solutions;
  • reviewing our services and platforms;
  • accessing publicly available resources;
  • contacting us about legitimate business requirements;
  • requesting information or support; and
  • following links to our platforms and authorised third-party services.

  • graphics, illustrations and visual assets;
  • product and platform names;
  • videos, photographs and audio;
  • reports, downloads and training materials; and
  • databases and other proprietary information.

You may view and use publicly available Website content for legitimate, non-commercial information purposes.

You may not reproduce, modify, publish, sell, licence, distribute or commercially exploit our content without prior written permission, except where permitted by law.

Names and trademarks belonging to our technology partners, suppliers or other third parties remain the property of their respective owners.

When you contact us or submit information through the Website, you confirm that:

  • the information is accurate to the best of your knowledge;
  • you are authorised to provide it;
  • it does not infringe another person’s rights;
  • it is not unlawful, harmful or misleading; and

Submitting an idea, proposal or business enquiry does not create a confidential relationship unless we have separately agreed to confidentiality in writing.

17Limitation of liability

To the fullest extent permitted by law, 3 Worx Solutions will not be liable for indirect, incidental, special or consequential loss arising from your use of, inability to use or reliance on the Website.

This may include loss of profits, revenue, business opportunities, anticipated savings, goodwill or data.

Where our liability cannot lawfully be excluded, it will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence or any other liability that may not lawfully be excluded.

18Indemnity

To the extent permitted by law, you agree to indemnify 3 Worx Solutions against claims, losses, liabilities and reasonable costs arising directly from:

  • your unlawful use of the Website;
  • your material breach of these Terms;
  • content or information you submit in violation of another person’s rights; or
  • your deliberate interference with the Website or its security.

This clause does not apply where the loss was caused by our own unlawful conduct, gross negligence or wilful misconduct.

19Electronic communications

When you use the Website, send us an email, submit an enquiry or otherwise communicate with us electronically, you consent to receiving communications from us electronically.

Electronic notices and communications may satisfy legal requirements that communications be in writing, subject to applicable law.

You are responsible for ensuring that the email address and contact information you provide are accurate and accessible.

20Changes to the Website or these Terms

We may modify the Website, its features or these Terms from time to time.

The updated Terms will display a revised effective date. Material changes may also be communicated through a Website notice or another appropriate method.

Changes take effect when the updated Terms are published, unless a later date is stated.

Continued use of the Website after updated Terms take effect constitutes acceptance of those changes.

Changes to a separate, existing customer contract will be handled according to that contract and will not be made solely by changing these Website Terms.

21Suspension and termination

We may suspend, restrict or terminate access to the Website where reasonably necessary to:

  • protect the Website or its users;
  • investigate suspected unlawful conduct;
  • address a security threat;
  • comply with a legal obligation; or
  • enforce these Terms.

Clauses which are intended to continue after termination—including intellectual property, disclaimers, liability and governing-law provisions—will remain effective.

22Governing law

These Terms are governed by the laws of the Republic of South Africa.

Subject to any consumer right to approach another competent tribunal, regulator or court, the courts of South Africa will have jurisdiction over disputes relating to the Website or these Terms.

Nothing in these Terms prevents a consumer from exercising rights or remedies available under the Consumer Protection Act or other applicable legislation.

23Dispute resolution

If a dispute arises, you should first contact us at support@3worxsolutions.com so that the parties can attempt to resolve it in good faith.

If the dispute cannot be resolved directly, either party may use any mediation, regulatory complaint process, consumer-protection mechanism or legal remedy available under South African law.

24Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to apply.

25No waiver

A failure or delay by 3 Worx Solutions to enforce any provision does not constitute a waiver of that provision or any other right.

26Entire agreement

These Terms, together with our Privacy Policy and any other policy expressly incorporated by reference, constitute the agreement governing use of the corporate Website.

They do not replace a separate quotation, customer agreement, subscription agreement, order or service contract governing a specific product or service.
